Terms and Conditions
1. In tendering the shipment for carriage, shipper warrants shipment is packaged to ensure safe transportation with ordinary care in handling.
2. The Professional LLC. shall not be liable for any loss, damage, delay, misdelivery, or other result not caused by its own negligence.
3. The Professional LLC. shall not liable for any loss, damage, delay, misdelivery or other result caused by (a) the claiming interest in the shipment; act, default, or omission of the shipper, consignee or any other part (b) acts of God, perils of the air, public enemies, public authorities acting under authority of law, quarantine, riots, strikes, civil commotions, or hazards incidental to a state of war; (c) compliance with delivery instructions from the shipper or the consignee; or (d) the perishable nature of any item.
4. The Professional LLC. shall not be liable for special, incidental, or consequential damages, including but not limited to loss of profits or loss of income, whether or not had knowledge such damages might be incurred.
5. No liability shall be provided on the following items unless the item is specifically listed on the shipping documents by description and value: bills of exchange, bonds, bullion, precious metals, currency, deeds, documents of title, evidence of debt, credit cards, firearms, money, gems, jewelry, precious stones, pearls, god, silver or platinum articles, including household articles such as silverware and coffee service, stock certificates, securities, stamp collections, stamps (postage, revenue, or trading), photographs, or photograph albums, or letters or packets of letters.
6. No liability shall be provided for any loss or damage arising out of the breakage of china, glassware, bric-a-brac, or similar artifacts of a brittle or fragile nature unless packed by employees or unless breakage results from negligence.
7. No liability shall be provided for a loss or damage caused by or resulting from (1) insects, moths, vermin, ordinary wear and tear, dust, or gradual deterioration; (2) defect or inherent vice of the article, including susceptibility to damage because of atmospheric conditions such as temperature and humidity change therein; or (3) mechanical or electrical derangement of pianos, radios, photographs, clocks, refrigerators, televison sets, automatic washers, computer equipment, or other instruments or appliances unless evidenced by external damage to such equipment.
8. All charges applicable to a shipment are payable in cash at the time of acceptance in the case of a prepaid shipment or at the time of delivery in the case of a collect shipment, unless has extended credit.
9. All claims pertaining to a shipment must be made, in writing to within 10 days after the date of acceptance of the shipment and all transportation charges thereon have been paid.
10. The Professional LLC. shall have lien on the shipment for all sums due and payable. Failure to pay billed charges will result in the imposition of a lien upon future shipments, including the costs of storage and appropriate security, therefore, pursuant to Cal Civil Code Section 3051.5 and, where applicable Ca. Commercial Code Section 7209.
11. The contact is entered into El Sobrante, California.
12. This contract shall be governed by the laws of the State of California. If any provision hereof is deemed illegal or otherwise determined to be invalid or unenforceable, the remainder of his contract shall not be affected thereby, but shall be enforced as if the offending provision had be stricken.
13. In the event action is taken to enforce or interpret the terms of this contract, the prevailing party shall be entitled to recover its reasonable attorneys’ fees and costs, regardless of whether the matter proceeds to trial.
